Tester Terms of Service

These Terms of Service ("Terms") govern your participation as a Tester on the TestGate platform ("Platform") operated by AppTestify Global Services Private Limited ("AppTestify", "we", "us", or "our"). By registering as a Tester and using the Platform, you agree to be bound by these Terms.

1. Acceptance of Terms

By registering as a Tester, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service, our Privacy Policy, and any Non-Disclosure Agreements (NDAs) you accept for specific projects. If you do not agree to these Terms, you may not use the Platform as a Tester.

You must be at least 18 years old and have the legal capacity to enter into these Terms.

2. Tester Registration and Account

To become a Tester, you must:

• Provide accurate, current, and complete information during registration
• Complete your profile with skills, experience, and device information
• Upload a valid government-issued ID and live photo for identity verification
• Record and upload a video introduction
• Accept the Non-Disclosure Agreement (NDA)
• Wait for identity approval from Platform administrators

You are responsible for:

• Maintaining the accuracy of your profile information
• Keeping your account credentials secure
• Accepting responsibility for all activities under your account
• Notifying us immediately of any unauthorized access

We reserve the right to reject, suspend, or terminate Tester accounts that violate these Terms or fail Identity verification.

3. Independent Contractor Relationship

You acknowledge and agree that:

• You are an independent contractor, not an employee of AppTestify or any Client
• You are not entitled to employee benefits, including but not limited to health insurance, retirement benefits, or paid time off
• You are responsible for your own taxes, insurance, and compliance with local labor laws
• You have the right to accept or decline test execution assignments
• You may work for other companies or platforms simultaneously

4. Testing Services and Responsibilities

When assigned to a test execution, you agree to:

• Follow all test instructions and requirements provided by the Client
• Test applications thoroughly and professionally
• Report bugs accurately, with detailed descriptions, steps to reproduce, and evidence (screenshots, videos, logs)
• Complete assigned test executions within specified deadlines
• Maintain confidentiality of all Client information and applications
• Not share, distribute, or publicly discuss any Client applications or project details
• Use only approved devices and environments for testing
• Report any security vulnerabilities or sensitive data exposure immediately

Failure to meet these responsibilities may result in removal from test executions, payment reduction, or account termination.

5. Non-Disclosure and Confidentiality

You acknowledge that you will have access to confidential information, including:

• Client applications, software, and proprietary technology
• Project details, test cases, and requirements
• Bug reports and quality insights
• Client business information and strategies

You agree to:

• Maintain strict confidentiality of all Client information
• Not disclose, share, or discuss any confidential information outside the Platform
• Not take screenshots, videos, or recordings except as required for bug reporting within the Platform
• Not reverse engineer, decompile, or attempt to extract source code
• Return or delete all confidential information upon completion of testing or termination

Breach of confidentiality may result in immediate account termination, legal action, and forfeiture of all payments.

6. Payment and Compensation

Payment terms:

• Payment amounts are determined by AppTestify based on test execution complexity, duration, and your performance
• Payments are made according to the payment schedule specified in your account
• You are responsible for reporting and paying taxes on all earnings
• Payment may be reduced or withheld for incomplete work, poor quality reports, or violations of these Terms
• Disputes regarding payments must be reported within 30 days of the payment date
• We reserve the right to adjust payment rates with 30 days' notice

7. Intellectual Property

Bug Reports: All bug reports, test results, and feedback you submit become the property of the Client upon submission. You grant the Client a perpetual, royalty-free license to use, modify, and distribute your reports.

Platform Content: The Platform, including its design, features, and functionality, is owned by AppTestify. You may not copy, modify, or create derivative works without permission.

Your Profile: You retain ownership of your profile information but grant AppTestify a license to use it for Platform operations, matching you with projects, and analytics.

8. Prohibited Conduct

You agree NOT to:

• Submit false, misleading, or duplicate bug reports
• Use automated tools or scripts to generate reports without actual testing
• Share account credentials or allow others to test on your behalf
• Attempt to access unauthorized areas of Client applications
• Engage in any form of fraud, manipulation, or gaming of the Platform
• Harass, abuse, or discriminate against Clients, other Testers, or Platform staff
• Violate any applicable laws or regulations
• Use the Platform for any purpose other than legitimate testing services

9. Quality Standards and Performance

Your performance is evaluated based on:

• Quality and accuracy of bug reports
• Timeliness and completion of test executions
• Client feedback and ratings
• Adherence to test instructions and requirements
• Professionalism and communication

Poor performance may result in reduced test execution assignments, payment adjustments, or account suspension.

10. Termination

Either party may terminate this relationship at any time:

• You may deactivate your account at any time through account settings
• We may suspend or terminate your account immediately for violations of these Terms
• Upon termination, your access to the Platform will cease immediately
• Outstanding payments will be processed according to our payment schedule
• Confidentiality obligations survive termination

11. Disclaimers and Limitation of Liability

THE PLATFORM IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We do not guarantee:

• Continuous availability of test executions or assignments
• Minimum payment amounts or earnings
• Specific number of test execution assignments

TO THE MAXIMUM EXTENT PERMITTED BY LAW, APPTESTIFY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF THE PLATFORM.

12. General Provisions

Governing Law: These Terms shall be governed by the laws of India.

Modifications: We reserve the right to modify these Terms. Material changes will be notified via email or Platform notification.

Entire Agreement: These Terms, together with our Privacy Policy and NDAs, constitute the entire agreement.
